TERMS AND CONDITIONS

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE. Hayley’s Guns and Ammo, LLC (“Hayley’s Guns and Ammo”) welcomes you into our family of customers. All users of this site agree that access to and use of this website, https://hayleysgunsandammo.com (the “Site”), are subject to the following terms and conditions and other applicable law contained herein (the “Terms”). These Terms apply to the Site, and all provided services, including webinar services and all drawings associated therewith, whether viewed on the Site, on a mobile device, on a PC, or on any other platforms, such as Facebook. It also applies to all of our advertising and related activities on all of these platforms as described below, as well as any other services that we may provide to you from time to time. In these Terms, we refer to our website, webinars, drawings, advertising activities, and other services collectively as our “Services.”

Before you purchase products from this Site or by accessing, downloading, and/or attending our webinars, participating in drawings, or otherwise using our Services, you must agree to our Terms. If you do not agree to these Terms, please do not use this Site.

DISCLAIMER: By registering with Hayley’s Guns and Ammo, you confirm that you are the appropriate age to purchase items including but not limited to, firearms, ammunition, knives, and/or magazines and there are no local, state or federal laws prohibiting you from purchasing, receiving or owning such items.

Terms and Conditions

All customers must agree to Hayley’s Guns and Ammo statements and terms of sale before an order is placed. All orders are subject to review and approval by Hayley’s Guns and Ammo.

Customer Affirms:

I am a U.S. citizen. I am not an illegal or unlawful alien.
I am currently 21 years old or older if purchasing handgun ammunition,
a handgun or a receiver, or eighteen 18 years or older (21 in Florida) if
purchasing rifle ammunition or a rifle.
By selling or delivering a firearm or ammunition to me or my selected Federal
Firearms Licensed Store (“FFL”), Hayley’s Guns and Ammo is not violating any
state or local law or ordinance.
I am not under indictment for and have never been convicted in any court of law
of a crime punishable by imprisonment for over a year.
I am not a fugitive from justice of any kind.
I am not an unlawful user or addicted to any controlled substance.
I have not been adjudicated as mentally ill, and I have not been committed to
any mental institution of any kind.
I have never been nor am I expected to be discharged from the Armed Forces
under dishonorable conditions of any kind.
I have not renounced my U.S. citizenship.
I am currently not subject to any restraining order.
I have never been nor am I expected to be convicted in any court of a
misdemeanor or felony crime of domestic violence.
I will use products purchased from Hayley’s Guns and Ammo for lawful
purposes only.

Firearms Sales

All firearms are shipped to an FFL on your behalf. You may be asked to provide Hayley’s Guns and Ammo with the FFL information of your choice.

Prior to placing your order, please verify the following with your FFL of choice:

The FFL will accept the transfer for all of the items on your order. This ensures your dealer is willing to transfer your firearm, the firearm is legal in your state, and they are willing to do compliance work.
The FFL is currently in business.
Confirm the FFL’s business address for your order.
Any additional transfer fees charged by the FFL for the transfer.

If you change the FFL information you originally provided to Hayley’s Guns and Ammo after your order has shipped, you will be charged for any additional shipping expenses that coincide with such change.

You may pick up your firearm at the FFL of your choice only if you pass a National Instant Criminal Background Check conducted at the FFL at the time of pickup.

After the transfer, all sales are final, and firearms cannot be returned to Hayley’s Guns and Ammo.

Hayley’s Guns and Ammo is not responsible for any items refused by your FFL. If the FFL of your choice is not available at the time of delivery and the package is returned to Hayley’s Guns and Ammo, additional shipping charges will apply to orders that must be reshipped.

By ordering a firearm, you certify you are the actual transferee/buyer of the firearm, are of legal age and satisfy all federal, state and local legal/regulatory requirements to purchase this firearm.

Shipping Restrictions for Firearms, Ammunition & Magazines

All firearms must ship to an FFL.
Hayley’s Guns and Ammodoes not ship outside the continental United States.
We do not ship ammunition to PO, APO or FPO Boxes.

The following shipping restrictions apply to high-capacity magazines:

Alaska – No sales.
California – No magazines greater than 10 rounds.No direct sale of ammunition, unless the purchasing individual is exempt from California state law. If you are not exempt, all ammunition orders must be shipped to an FFL for transfer. Exemptions include, but are not limited to: Law Enforcement Officers, peace officers, and FFL holders (Type 03 FFLs included).
Colorado – No magazines greater than 15 rounds.
Connecticut – No magazines greater than 10 rounds. A valid/not expired Connecticut Carry Permit or Ammunition Certificate is required.
Delaware – No magazines greater than 17 rounds.
District of Columbia – No Sales.
Hawaii – No sales.
Illinois – A valid/not expired Illinois Firearm Owner’s Identification (FOID) card is required. The shipping address provided on the order must match the address shown on the FOID.
Maryland – No magazines greater than 10 rounds.
Massachusetts – A valid/not expired Firearms License to Carry (LTC) is required. The shipping address provided on the order must match the address shown on the LTC.
New Jersey – No magazines greater than 10 rounds.
New York – No magazines greater than 10 rounds. All New York State residents must have ammunition shipped to an FFL.
Washington State – No magazines greater than 10 rounds.

We do not ship to any other area within the United States where we are prohibited by federal, state, or local law to ship a product. You understand that if you attempt to have a product shipped to these restricted areas, your order will be canceled, and you will be subject to paying a 20% cancellation fee.

It is the customer’s responsibility to know the laws in his or her jurisdiction prior to purchasing products provided by Hayley’s Guns and Ammo. No product offered for sale by Hayley’s Guns and Ammo will be knowingly shipped or transferred to a person in any jurisdiction where it is unlawful to receive or possess such product.

Firearm and Ammo Shipping & Delivery

Firearms will incur an additional long gun or handgun shipping surcharge.

Handguns MUST be shipped via UPS or FEDEX.

Shipping & Delivery Policy

Orders for products generally ship UPS, FedEx or USPS Mail. Hayley’s Guns and Ammo reserves the right to change or alter shipping methods from those selected at checkout without notice. Once your product is received by the carrier, you automatically assume all responsibility for its safe transit to your delivery address, and thereafter. You also agree to hereby explicitly release Hayley’s Guns and Ammo from all liability and responsibility thereafter. Hayley’s Guns and Ammo is not responsible for any lost or damaged packages after delivery.

When appropriate, a hazardous materials surcharge may be added to your order. A signature may be required on some packages and all hazardous materials packages.

All ammunition must be shipped via ground shipping according to federal law.

Shipping Insurance

Shipping insurance for firearms is not included by default. Customers have the option to add insurance to their orders during the checkout process. If customers choose not to add insurance, Hayley’s Guns and Ammo is not responsible for any issues relating to shipment or package delivery, including but not limited to loss, damage and/or theft.

If a customer who selects shipping insurance during the checkout process, would like to begin a claim, please email us at Hayleysgunsandammo@outlook.com with your order number and a detailed description of the issue. All claims are subject to review by Hayley’s Guns and Ammo and purchase of shipping insurance is not a guarantee of reimbursement.

If a claim is approved, the customer may be reimbursed via the following methods:

Refund to the customer’s original payment method of the cost of the original merchandise, excluding sales tax (if applicable), shipping and/or handling charges, and the cost of shipping insurance per the customer’s order number/invoice.
Store credit of the cost of the original merchandise, excluding sales tax (if applicable), shipping and/or handling charges, and the cost of shipping insurance per the customer’s order number/invoice.
At the discretion of Hayley’s Guns and Ammo: re-shipment of the customer’s merchandise as previously purchased per the customer’s order number/invoice.

All shipping insurance claims must be made within 30 days of the date of purchase. Any claims made after 30 days of the date of purchase will be denied. Once a customer has contacted Hayley’s Guns and Ammo and initiated a shipping insurance claim, Hayley’s Guns and Ammo will reach out to the customer within a reasonable time frame. If a customer does not respond within 5 days of Hayley’s Guns and Ammo’s last message, the claim will be closed. Hayley’s Guns and Ammo may request additional photos and/or videos of the shipment/package, as well as a police report if a package is reported stolen.

Hayley’s Guns and Ammo’s shipping insurance will not reimburse shipping insurance claims including, but not limited to:

Invalid and/or incomplete shipping address
Shipment/package marked “Return to Sender”
Merchandise/product missing within a shipment with no evidence of tampering
Orders not yet marked “Shipped”
Custom-order merchandise
Merchandise/product packaging is damaged, but merchandise/product is still usable.

Return, Refund & Exchange Policy

All ammunition and gunpowder sales are final.

All products purchased through special order are final.

Returns

Except for ammunition and gunpowder, returns and exchanges are approved of on a case-by-case basis within 30 days from carrier confirmed delivery. Please contact us at Hayleysgunsandammo@outlook.com to initiate your return or exchange.

Upon approval, please mail your product(s) to the following address:

Any eligible returns and exchanges must be returned in its original packaging. You are responsible for all return shipping costs, unless otherwise agreed upon by Hayley’s Guns and Ammo. Once the 30-day return and exchange window has passed, you will not be eligible for a full refund or exchange.

A restocking fee up to 20% may apply to returns and exchanges. All returns and exchanges will be subject to inspection upon receipt by Hayley’s Guns and Ammo. Hayley’s Guns and Ammo will only accept returns and exchanges on products that are unused, undamaged, and unopened. Any products deemed damaged or inoperable due to the improper handling or use by a customer will not be accepted for a return or exchange.

Unless otherwise stated in the product description, all products sold are new and under warranty from the manufacturer. Should any items be defective, Hayley’s Guns and Ammo will provide a shipping label at no charge to return the defective item(s) and will give you a full refund, including shipping costs, if returned within 30 days from carrier confirmed delivery. All products must be packed in the original packaging, including any accessories, manuals, documentation, and registration that shipped with the product.

Refunds:

Once your return is received and inspected, we will notify you via email that we have received your return item. If your return is approved, all refunds, minus any applicable shipping and handling fees, will be credited to the customer’s account (credit card/original method of payment) that was used at the time of purchase. To receive a refund, the product(s) must be received within 30 days from carrier confirmed delivery.

For defective or manufacturer issues with products, please contact the manufacturer for warranty support.

Order Cancellation Policy

It is the customer’s responsibility to ensure that the correct products are ordered. Orders cannot be edited once they are submitted. Orders that are canceled after submission may be subject to a 20% cancellation fee. Once an order has been shipped and tracking information is generated, the order cannot be canceled. This policy helps ensure all orders will go out quickly. Refusal to accept delivery of an order may be subject to a restocking fee of 20%, as well as any return shipping charges.

Agreement to Indemnify and Defend for Misrepresentation

In the event that any of the above statements are determined to be untrue, you agree to indemnify and defend Hayley’s Guns and Ammo, and its owners, agents, officers, and employees against any resulting civil liability or criminal prosecution.

Release of Liability and Agreement to Indemnify and Defend

Hayley’s Guns and Ammo is a retailer of dangerous products. By placing an order with Hayley’s Guns and Ammo, you explicitly agree to release Hayley’s Guns and Ammo from any and all liability arising from or related to the products purchased to include, but not limited to, the use of the product, the storage of the product, and the transportation of the product. You also acknowledge that you are responsible for how you use the product and any third-party use. In the event that any other party files a claim of any kind against Hayley’s Guns and Ammo, you will indemnify and pay to defend Hayley’s Guns and Ammo and its owners, agents, officers, and employees against any resulting civil liability or criminal prosecution.

Errors and Omissions

Hayley’s Guns and Ammo makes every effort to have accurate and complete information on our Site, including but not limited to pricing, availability, and product features, however, we occasionally make mistakes. Customer agrees that they will not hold Hayley’s Guns and Ammo liable for such mistakes or omissions and acknowledges that orders may be canceled after the fact due to errors or omissions.

Links to Third Party Sites || Third Party Services

Hayley’s Guns and Ammo may contain links to other websites (“Linked Sites”). The Linked Sites are not under the control of Hayley’s Guns and Ammo and Hayley’s Guns and Ammo is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Hayley’s Guns and Ammo is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Hayley’s Guns and Ammo of the Site or any association with its operators.

Certain services made available via this Site are delivered by third party sites and organizations. By using any product, service or functionality originating from the https://hayleysgunsandammo.com domain, you hereby acknowledge and consent that Hayley’s Guns and Ammo may share such information and data with any third party with whom Hayley’s Guns and Ammo has a contractual relationship to provide the requested product, service or functionality on behalf of Hayley’s Guns and Ammo users and customers.

No Unlawful or Prohibited Use || Intellectual Property

You are granted a non-exclusive, non-transferable, revocable license to access and use https://hayleysgunsandammo.com strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to Hayley’s Guns and Ammo that you will not use the Site for any purpose that is unlawful or prohibited by these terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.

All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of Hayley’s Guns and Ammo or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.

You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. Hayley’s Guns and Ammo content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use and will make no other use of the content without the express written permission of Hayley’s Guns and Ammo and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of Hayley’s Guns and Ammo or our licensors except as expressly authorized by these Terms.

International Users

The Site is controlled, operated, and administered by Hayley’s Guns and Ammo from our offices within the United States of America. If you access the Site from a location outside the United States of America, you are responsible for compliance with all local laws. You agree that you will not use the Hayley’s Guns and Ammo content accessed through https://hayleysgunsandammo.com in any country or in any manner prohibited by any applicable laws, restrictions, or regulations.

Jurisdiction

You agree that if you, or someone else affected by your use of any product purchased from Hayley’s Guns and Ammo, brings a legal claim of any kind against Hayley’s Guns and Ammo, or any of its owners, agents, officers, or employees, that such legal action must be filed in Federal Court in the United States District Court for the Northern District of Texas located in Dallas, Texas. You also agree that any complaints filed within any other jurisdiction shall be immediately terminated and moved to the United States District Court for the Northern District of Texas located in Dallas, Texas, and agree to reimburse Hayley’s Guns and Ammo and its owners, agents, officers, and employees for any costs they may each incur in defending against the complaint or effecting its removal until such time that the complaint is properly filed in the United States District Court for the Northern District of Texas located in Dallas, Texas.

Changes to Terms

Hayley’s Guns and Ammo reserves the right, in its sole discretion, to change the Terms under which https://hayleysgunsandammo.com is offered. The most current version of the Terms will supersede all previous versions. Hayley’s Guns and Ammo encourages you to periodically review the Terms to stay informed of our updates.

Webinars, Drawings & Promotions

Eligibility & Promotion Period

Eligibility: NO PURCHASE OR CONTRIBUTION NECESSARY. A PURCHASE, CONTRIBUTION, DONATION, OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.

Part of the Site includes webinars and potential participation in drawings for various products and/or services endorsed, promoted, sponsored, exhibited, and/or reviewed on the Site (the “Promotion”). The Promotion is open to legal residents of all fifty (50) states in the United States of America and the District of Columbia, who are at least eighteen (18) (or twenty-one (21), as applicable) years of age or older at time of participation/entry and legally eligible to own and/or possess a firearm or firearm related items. All Federal, State, and local laws and regulations apply, including that felons are expressly prohibited from participation in any Promotion. Any Promotion is void in Puerto Rico, Guam, the U.S. Virgin Islands, and where otherwise prohibited by law. If you do not meet any of the requirements in these official rules, you are not eligible to win a prize, and Hayley’s Guns and Ammo reserves the right to not award prizes to you.

Directors, officers and employees of Hayley’s Guns and Ammo and any of their respective parent companies, affiliate companies, subsidiaries, agents, professional advisors, advertising and promotional agencies, and immediate families of each are not eligible to win any prizes. All applicable federal, state, and local laws and regulations apply. Limit one entry per person if any entrant is found to have used multiple or different accounts, or other applicable accounts to submit more than one entry per person, such entrant will be disqualified.

Promotion Period: The Promotion starts when registration opens for a webinar, or any other time related to a Promotion not tied to or unrelated to a webinar and ends once the webinar registration period closes or any other specified time not tied to or unrelated to a webinar (the “Promotion Period”). All entries must be received during the Promotion Period and meet other requirements in these Terms to be eligible to win a prize.

Participation in any Promotion constitutes entrant’s full and unconditional agreement to these Terms, which are final and binding in all matters related to the Promotion. An award of any winnings is contingent upon fulfilling all requirements set forth herein.

Automatic Entry: An individual who watches one of Company’s hosted webinars will be awarded an automatic entry (“Automatic Viewer Entry”) per each unique view. Automatic entry in any form will not increase your chances of winning.
Promotional Entry (when applicable): During the Promotion Period, Company may issue Promotional Entry(ies) by any method made available during the Promotion Period, including, but not limited to, direct mail, email, and/or text message, for seat(s).

Sponsor

Hayley’s Guns and Ammo is no more than a sponsor of the products and services in any Promotion. Hayley’s Guns and Ammo does not claim, assert, or otherwise hold out any warranties, guarantees, or otherwise with respect to any product or service in any Promotion beyond those specific statements in any webinar related to said product or service.

Drawing

All participants who sign up to participate in any webinar are granted a Seat to attend the webinar which features information regarding specific products and/or services. At the end of each webinar, all participants will be eligible for a chance to win the specific product or service related to the subject of the webinar. Hayley’s Guns and Ammo will select the potential winner(s) of the Promotion. Eligible entrants received during the Promotion Period on or about each sweepstakes specified draw date.

Winnings/Odds

Hayley’s Guns and Ammo reserves the right to substitute any listed winnings for one of equal or greater value for any reason, without prior notice.

Odds of winning depend on the number of eligible webinar viewers and entrants received during the Promotion Period. Brand names are trademarks of brand owners who are not affiliated with any Promotion. There is no limit to the number of winnings a person can win.

Any potential winner(s) must continue to comply with these Terms, and winning is contingent upon fulfilling all requirements, including all applicable Federal, State, and local laws for such drawings, and, if applicable, for possessing a firearm. Potential winner(s) will be notified of their selection by email, text message, and/or mail after the drawing date. Potential winner(s) must claim the winnings online via our website, and agree to all further terms in connection therewith, within thirty (30) days of the date notice is given. If there is no response from any potential winner(s) within the allotted timeframe, the potential winner(s) will be disqualified. Further, if any potential winner fails to comply with these Terms or any further terms in connection with collection of their winnings, the potential winner will be disqualified.

If any potential winner is disqualified for any reason, Hayley’s Guns and Ammo will restart the drawing with the disqualified potential winner removed and select an alternative winner. An entrant is not deemed a winner of any winnings, even if the winning notification should so indicate, unless and until the entrant’s eligibility has been verified and the entrant has been notified that the acceptance and verification process is complete.

Identity of Entrant

In the event of a dispute about the identity of the entrant, entries made online will be declared made by the authorized account holder of the e-mail address submitted at time of entry. An authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be required to provide Hayley’s Guns and Ammo with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.

Taxes

Total Approximate Retail Values (“ARV”) of any winning(s) is based on available information provided to Hayley’s Guns and Ammo, including retail value, and the value of any winning(s) awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes, registration, or other expenses related to transfer of the winnings to the winner, and paying any expenses associated with any winnings that are not specifically provided for in the Terms. Each winner must provide Hayley’s Guns and Ammo with valid identification, mailing address, and a valid taxpayer identification number or social security number before any winnings will be awarded. Winnings are not transferable, assignable, redeemable for cash, or exchangeable for any other winnings. Any person winning any product or service valued at over six hundred dollars ($600.00) in winnings may receive an IRS form 1099 for the applicable calendar year and a copy of such form will be filed with the IRS by Company.

Publicity

Except where prohibited, participation in any Promotion constitutes entrant’s consent for Hayley’s Guns and Ammo, winnings providers, and their designees to use, for promotional purposes in any type of media without further payment or consideration, entrant’s name, likeness, city and state of residence, and any written or oral comments or testimonials to, or other feedback on, any winnings or entrant’s experience, or any other personal information of entrant. By participating, all entrants, participants, potential winners, finalists, and winners grant Hayley’s Guns and Ammo exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with any promotion of this and/or other Promotions or contests and waive any claims to royalty, right, or remuneration for such use. Further, except where prohibited, by participating in any Promotion, all entrants, participants, potential winners, finalists, and winners agree that Hayley’s Guns and Ammo may disclose personal information obtained from the foregoing in the sweepstakes to third parties and use such information for marketing and other purposes in addition to that noted herein.

General Conditions Related to Webinars, Drawings & Promotions

Hayley’s Guns and Ammo expressly reserves the right to, at its sole discretion to:

cancel, suspend, terminate, and/or otherwise modify any Promotion, or any part thereof, if any fraud or technical failure, or any other causes or events corrupt or impair the administration, security, fairness, integrity, and/or proper functioning of the Promotion, as determined by Hayley’s Guns and Ammo in its sole discretion, and
in the event any Promotion is so cancelled, suspended, terminated, or otherwise modified such that winnings are no longer available for award, award alternative winnings in a random drawing from the eligible entrants received prior to event requiring such action.

Hayley’s Guns and Ammo further expressly reserves the right in its sole discretion to disqualify any individual found to be tampering with the entry process or the operation of any Promotion or to be acting in violation of these Terms, or any further terms specific to any Promotion or award thereof, or any other Promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of any Promotion may be a violation of criminal and civil law in addition to, and independent of any, violation of these Terms, and should such an attempt be made, Hayley’s Guns and Ammo reserves the right to seek damages from any such person to the fullest extent permitted by law. Hayley’s Guns and Ammo’s failure to enforce any of these Terms, or any further terms specific to any Promotion or award, shall not constitute a waiver of that rule.

Hayley’s Guns and Ammo is not responsible for printing or typographical errors, or inaccurate registration information, lost, late, incomplete, invalid, unintelligible, incomplete, or misdirected entries, all of which will be disqualified. All entries become the sole and exclusive property of Hayley’s Guns and Ammo and will not be returned. Hayley’s Guns and Ammo reserves the right to contact entrants and all other individuals whose email address is submitted as part of any Promotion. Except where prohibited, and without limiting the foregoing, all winnings provided will be new, in original condition unless otherwise stated, and are provided “as is” without warranty of any kind, either express or implied, including but not limited to, the implied warranties or merchantability, fitness for a particular purpose or non-infringement. However, if a product is received in damaged condition Hayley’s Guns and Ammo shall attempt to remedy the situation by providing a replacement of the same product or another product of equal or greater value, at Hayley’s Guns and Ammo sole discretion.

Entry Conditions and Release and Limitations of Liability

By entering and/or participating in any Promotion, each entrant and/or winner hereby, on behalf of themselves, their executors, heirs, and assigns, agrees to:

comply with and be bound by these Terms and any further conditions with respect to any specific Promotion, and the decisions of Hayley’s Guns and Ammo, which are binding and final in all matters relating to any Promotion;

release, indemnify, and hold harmless Hayley’s Guns and Ammo, the winnings suppliers, and any other organizations or individuals responsible for fulfilling, administering, advertising, or promoting the Promotion, and all of their respective past and present officers, directors, employees, agents, and representatives (collectively, the “Released Parties”) from and against any and all expenses, liability, and/or claims of actions of any kind, whatsoever for injuries, damages, and/or losses of any kind to persons or property, including, but not limited to, negligence and damages caused by any disclosure of private facts, false light in the public eye, or any other legal theory, defamation, slander, libel, violation of right of publicity, infringement of trademark, patent, copyright, or other intellectual property rights, property damage, death, or personal injury sustained in connection with, arising out of, and/or relating to:
the conduct, promotion, or outcome of any Promotion, including, but not limited to, an entrant’s entry, and/or participation in any Promotion;
the receipt, acceptance, ownership, use, or misuse of any winnings (including any travel or activity related thereto) and/or the broadcast, exploitation, or use of entry or winnings; and

iii. the preparation for participation in or traveling to and/or from any winnings-related activity in connection with the Promotion or otherwise.

indemnify, defend, and hold harmless Hayley’s Guns and Ammo and all Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorney’s fees) arising out of or relating to an entrant’s participation in the Promotion and/or entrant’s acceptance, use or misuse of winnings, including as set forth hereinabove; and

Under no circumstances will Hayley’s Guns and Ammo or the Released Parties be liable for punitive, incidental, consequential, or any other damages. The Released Parties are not responsible for:

any incorrect or inaccurate information, whether caused by entrants, printing errors, or any of the equipment or programming associated with or utilized in any Promotion;
technical failures of any kind, including, but not limited to, malfunctions, interruptions, or disconnections in phone lines or network hardware or software;
unauthorized human intervention in any part of the entry process or any Promotion; or
technical or human error which may occur in the administration of any Promotion or the processing of a Seat or an award of any winnings.

Any entrant receiving any winnings guarantees that they are able to receive said winnings and are not otherwise prohibited from possession, custody, and/or control of the specific winnings. If any entrant is so prohibited, that entrant will be disqualified for any specific Promotion. Further, any attempts to bypass such limitation(s) by registering as another person or by a non-prohibited person knowingly giving any winnings to a prohibited person will result in the voiding of all entries of said entrant, including any otherwise valid entries, and disqualification of all persons involved from the Promotion and any of Hayley’s Guns and Ammo’s other Promotions, both past and future.
